The man, who is a relative of the baby, was arrested when the viewers of his Facebook Live session quickly called the attention of the police.
The prosecutors said the defendant did the stunt to gain a high number of likes and views from the social media platform.
In an unexpected twist, the father of the baby pleaded for the defendant stating that the defendant was simply playing games.
The defendant alleged that the balcony had protective bars that were photoshopped/removed by Facebook users in the viral image.
The Algerian court was however not convinced by his explanation and he was found guilty of the child abuse charges.
He has been sentenced to two years imprisonment.
